Terms of Service
Last updated October 18, 2026
These terms govern Sortiva account access and its hiring and employee scheduling tools. You must expressly accept the current terms before accessing your workspace or using protected features. Applicants and other participants also have separate participant terms; optional call, recording and messaging permissions remain separate.
1. Eligibility and accounts
You must be at least 18 years old and able to enter into a binding contract. If you sign up on behalf of a business, you confirm you are authorized to bind that business. You are responsible for the accuracy of your account information, for keeping your credentials secure, and for all activity that happens under your account. Tell us promptly if you suspect unauthorized access.
Sortiva is a business-to-business service. If you use it for a company, you represent that the company has authority to provide candidate, reference and employee data to Sortiva and to instruct Sortiva to process that data for the service.
2. Your use of the service
Sortiva gives you tools to post jobs, collect applications, run AI-assisted phone screening, organize reference information, build employee schedules, and track employee certifications and expiration dates. AI reference calls and texting are currently unavailable. You keep ownership of the content and data you put into Sortiva. You grant us the limited rights needed to host, process and display that data in order to provide the service.
You are responsible for lawful collection of that data, for notices and consent you must give or obtain, for retention instructions, and for responding to access, correction, deletion, portability, appeal, authorized-agent or opt-out requests where applicable. Sortiva processes workforce and applicant data to provide, support and secure the service, and as described in the Privacy Policy.
3. Acceptable use
You agree not to:
- Use Sortiva for unlawful, discriminatory, or deceptive hiring practices.
- Upload data you do not have the right to share, or contact people who have asked not to be contacted.
- Use automated calls, recordings or text messages in a way that violates applicable telemarketing, consent or recording laws in the recipient's jurisdiction. See our SMS Terms & Conditions for text messaging rules.
- Attempt to reverse engineer, resell, scrape, overload, or bypass the security of the service.
- Upload malware or use the service to harass or harm anyone.
You remain the employer of record for your hiring decisions and are responsible for complying with employment, nondiscrimination, licensing, background-check, calling, texting and data-protection laws that apply to you.
Before using any feature, you are responsible for determining whether your intended use is lawful in every applicable jurisdiction, including applicable federal, state, county, city and other local laws and the laws relevant to affected applicants, employees, references and communication recipients. You must monitor changes that affect your use, obtain required permissions and consents, give required notices, and complete required assessments, audits and human review. If a law or regulation restricts or prohibits your intended use of a feature, you must stop that use unless and until it is lawful.
Feature availability, examples, suggested workflows, templates, support materials and product descriptions are not legal advice, a determination that your use is lawful, or a guarantee of compliance in any jurisdiction. Obtain qualified advice when needed. You must not use Sortiva for unlawful purposes, evade safeguards, or use it outside authorized purposes. You remain responsible for the instructions, configurations, content, decisions and conduct of the people you authorize to use your account.
3A. Screening questions, safeguards and employer responsibilities
You may supply job-related screening questions or let Aria select questions from the role and stated duties. You must not request, disguise, encode, or instruct Aria to ask prohibited personal questions or bypass safeguards. This prohibition applies to questions, job descriptions, uploaded content and other instructions.
Sortiva prohibits screening questions about race, ethnicity, national origin, religion, age or birth date, sex, gender identity, sexual orientation, pregnancy, marital or family status, childcare, disability, medical or injury history, genetic information, criminal history, salary history and sensitive identifiers. Use separate, legally reviewed processes for background checks, eligibility documents and any legally required inquiries. Ask about the stated duties and hours, not personal reasons for availability. Our product restrictions may be broader than the law applicable to a particular employer.
Question controls and Aria's instructions are safeguards, not legal advice or a guarantee that every inappropriate question, transcription error or AI response will be detected. A question passing a control is not approval of its legality. You must review screening results, correct material errors, disregard protected information, and make your own lawful hiring decisions. Report an inappropriate question to Sortiva and do not rely on its answer.
You are responsible for the content you supply and for complying with applicable federal, state, county and city laws, including changes in those laws. AI delivery of your instructions does not remove those responsibilities. Sortiva may block questions, prevent calls or restrict use that violates these terms. Nothing in these terms excludes responsibility or liability that applicable law does not permit a party to exclude, or waives an applicant's nonwaivable rights.
Screening calls have a maximum of ten minutes, including disclosure and closing, and may finish sooner. Written answers may be used to avoid repetition. Unasked questions or uncertain answers require human review and do not establish that an applicant is unqualified. Adding custom questions does not extend the limit.
4. AI-generated output
Sortiva uses AI models to transcribe calls, summarize conversations, and calculate how an applicant's stated answers compare to the requirements the employer set. These outputs are assistive and can be incomplete or wrong. They are not employment advice, background verification, or a substitute for your own judgment. You should independently review candidate information before making a hiring decision.
You must configure job-related criteria lawfully, avoid discriminatory use, provide human review, and offer reasonable accommodation or an alternative selection process where required. You are responsible for complying with applicable automated-employment laws, including notices and bias audits when a jurisdiction requires them. You must configure and review your requirements lawfully and remain the decision-maker.
5. Calls and text messages
Applicants may supply professional references and separately authorize the employer to contact those listed people. Listing a reference or agreeing to applicant screening does not supply the reference's own permission for automated calls, text messages, recording or transcription. Obtain that person's permission through an appropriate participation process before automated contact. Do not treat a request for consent by text as permission to send an otherwise unauthorized initial text.
Reference checks must concern job-related work evidence. Sortiva prohibits questions about attendance or absence history, medical or protected leave, and other protected personal topics. Declined answers, company disclosure restrictions, missing information and transcription failures are not adverse evidence. Reference summaries are for employer review and do not independently change a candidate's screening percentage or make a hiring decision.
Before using Sortiva to call or text someone, you must have authority to contact that person and must comply with applicable recording, calling, texting, do-not-contact and time-of-day laws. Sortiva's in-product consent controls support these workflows, but they do not replace your own legal obligations.
Texting is currently unavailable, including applicant interview SMS and employee text-in scheduling requests. Application consent records, listed allowances or software functionality do not mean a messaging program is active. The intended separate programs are described in the SMS Terms & Conditions.
6. Subscriptions and billing
Sortiva offers paid subscription plans as shown when you choose a plan and in Settings → Billing. By subscribing, you authorize us to charge your payment method for the plan and billing period you select. Subscriptions renew automatically at the end of each billing period unless cancelled before renewal. Fees are charged in advance and are non-refundable except where required by law. You can cancel or change your plan at any time from your account billing settings; cancellation takes effect at the end of the current billing period. We may change our pricing with reasonable advance notice, which will not apply to a billing period already in progress.
Free trials. Starting a plan requires a valid payment method. New subscriptions get a 7-day free trial only when that offer is shown at checkout and the customer is eligible. If you choose immediate payment or have already had a subscription, no trial is promised. When a trial applies, cancelling before it ends prevents the first subscription charge. If you do not cancel, your payment method will automatically be charged the renewal price and frequency shown when you chose the plan, and your subscription will continue on a recurring basis until cancelled. Trial accounts include a smaller usage allowance than paid plans, as described in the Usage allowances and credits section below.
7. Usage allowances and credits
Each plan — and any eligible 7-day free trial when that offer is shown at checkout — includes an allowance of AI voice screening minutes and SMS messages, as shown when you choose a plan and in Settings → Billing. The trial allowance is deliberately smaller than any paid plan's.
Eligible usage beyond the included allowance may draw from purchased credits, subject to available balance, plan eligibility, service availability and applicable sending controls. Credits can be purchased in packs at any time from Settings → Billing. Purchased credits are non-refundable except where required by law. Unused monthly allowance does not roll over between billing periods. We may adjust allowance amounts or credit pricing with reasonable advance notice, consistent with the pricing-change terms in the Subscriptions and billing section above.
8. Confidentiality, security and data
We use reasonable technical and organizational safeguards designed to protect customer data and keep each employer's workspace separate. You and Sortiva will each use confidential information received through the service only for the service and related business purposes, and will protect it from unauthorized disclosure.
9. Third-party services
Sortiva depends on third-party providers for voice calls, messaging, email delivery, AI models, hosting and storage. Their availability and performance are outside our control, and your use of the service through them is subject to their terms.
10. Service availability
We aim to keep Sortiva available and reliable, but we do not guarantee uninterrupted service. Features may change, be added, or be removed as the product develops, and we may perform maintenance that temporarily limits access.
11. Disclaimer of warranties
The service is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, or the accuracy of AI-generated results, to the fullest extent permitted by law.
12. Limitation of liability
To the maximum extent permitted by law, Sortiva and its operators will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, lost revenue, lost data, or hiring outcomes. Our total aggregate liability arising out of or relating to the service will not exceed the greater of the amounts you paid us in the twelve months before the claim or one hundred US dollars.
To the extent permitted by applicable law, Sortiva, its operator, affiliates, developers, employees, contractors and agents are not responsible for violations caused by your unlawful instructions, configurations, decisions or unauthorized use, or by your failure to comply with laws applicable to your use, including changes in those laws. This does not excuse our own unlawful conduct, remove obligations imposed on us by law, or exclude any liability or remedy that applicable law does not allow us to exclude or limit.
13. Indemnity
To the extent permitted by law, you agree to indemnify Sortiva, its operator, affiliates, developers, employees, contractors and agents against third-party claims and reasonable expenses caused by your unlawful use of the service, your unauthorized disclosure of data, or your breach of these terms. This obligation does not apply to the extent a claim is caused by the protected party's own unlawful conduct, negligence or breach of these terms, or where applicable law prohibits the obligation.
14. Termination
You may stop using Sortiva and close your account at any time. We may suspend or terminate access if you breach these terms, if your use creates legal or security risk for us or others, or if we discontinue the service. On termination, your right to use the service ends. Before using self-service deletion, export any data you need; deletion and remaining limited records are handled as described in the Privacy Policy.
15. Changes to these terms
We may update these terms as the product evolves. Material changes will receive reasonable advance notice when practical and will apply prospectively from their effective date. Non-material changes may take effect when posted.
When a new version requires acceptance, protected access remains blocked until you expressly agree. A prior acceptance is not silently updated.
